Krystal Cordovano: Actually, if your green card status is valid, and your baby was born in England, you could take your baby with you to the US without an immigrant visa. This would be assuming this is your first trip back to the US after the birth of the child. You wouldn't need to file an immigrant petition, and if you did, it would take 5 years for the petition to become valid. The baby would get a green card after arrival. Your fiance can't benefit from your status though. One, your not marr! ied. Two, you would need to file an immigrant petition for him, after marriage, and wait for 5 years, unless you became a citizen first. In that case, your petition would be upgraded to IR-1 and he'd be able to come a lot faster. Of course, it would be simpler from an immigration standpoint, if the child were born in the US.
